Subject: [publishing] Possible issue with orphaned REALMS contracts

This really only applies to people with contracted stories orphaned in the Realms of Fantasy shut down, but per an email I received from Sovereign / Homestead Publishing today, they have not yet determined the disposition of the story rights. Since our contracts are with Sovereign / Homestead Publishing and not with Realms of Fantasy, and Sovereign is still in business, reversion clauses are not clear-cut. (And I need to go drag out my most recent contracts with them and check this out.)

So, if you're a Realms orphan, I strongly advise not attempting to remarket your story for the time being, to avoid creating a contractual problem.

Note: if you had a story orphaned in slush, without a contract in hand, this will not affect you.

I have to admit, I was surprised to hear that folks were already re-marketing their stories. I've been waiting to either get official word that it was cool, or the time to lapse, whichever. After pondering, I came to the conclusion that maybe some folks had maybe gotten word of acceptance, but not had time to receive and sign contracts, and so were free to do whatever.

Fortunately it doesn't apply to me either, because my last story was sold but not yet contracted. Still, I am surprised that they're being hesitant about returning the rights. The only obvious rationale for that is if there was a chance the mag, and thus its inventory, might be sold.

Even so, the termination clause would kick in after 2 years.

Thanks for the update, Jay. For some reason, they haven't sent me the same courtesy mail, or any other mail for that matter, which is very frustrating.

What you said is what I've been planning to do all along. Wait for this to all play out. No reason to be hasty.

Although I will say that in my case, I signed a contract but never received payment. So tecnically they are the ones in breach.
