Unapproved genetically modified wheat from Monsanto found in Oregon field

Haven't these people seen Jurassic Park? And probably not the cause in this particular instance, since this strain is not commercially available, but haven't there been horror stories of Monsanto driving their seed trucks by farmers' fields and letting wind do the dirty work, then coming back and suing the farmers for using their proprietary seeds?
